Virginia Statewide Criminal, Virginia County Criminal, and Virginia MVR searches will now include a record sealing disclosure notice. This update supports compliance with Virginia's Clean Slate Act (Va. Code § 19.2-392.16), effective July 1, 2026.
Key Updates
Virginia Statewide Criminal and Virginia County Criminal searches: The notice will display when the search is completed and flagged with a record.
Virginia MVR searches: The notice will display on all Virginia MVR searches, regardless of result. MVR results are not parsed for violations, so this notice cannot be limited to searches with reportable record information the way criminal searches can.
Where a Statewide Criminal or County Criminal search is flagged with a record, the following notice will display at the search level:
Virginia Criminal History Notice: Virginia criminal history information contained in this report was collected on [Collection Date]. This report may include Virginia criminal history records that have been sealed since that date pursuant to Virginia law.
Where a Virginia MVR search is included, the following notice will display at the search level:
Virginia Traffic History Notice: This report includes a Virginia MVR search. If that search returned traffic history information, it was collected on [Collection Date] and may include records that have been sealed since that date pursuant to Virginia law.
The Collection Date reflected in either notice uses the review date (when it was sent to QA), if one was recorded for that search. If no review date exists, the Collection Date reflects the date the search was completed.
Impact
No configuration changes are needed.
CRAs should expect the Virginia Criminal History Notice to display automatically on Virginia Statewide Criminal and County Criminal searches flagged with a record, and the Virginia Traffic History Notice to display on all Virginia MVR searches.
